- Acceptance of Terms. By using this website you agree to be bound by these “Terms of Use.”
- Definitions. The “Kenzie’s Optics Website” or “the Website(s)” means the websites associated with the domain names kenziesoptics.com.
- Use of the Site. Kenzie’s Optics operates the Websites to provide online access to information about Kenzie’s Optics and its products, services, and opportunities, as well as to sell certain products, and to provide a way to communicate with Kenzie’s Optics. Any new features added to the Websites will also be subject to these Terms of Use.
- Intellectual Property. The content on the Websites, except all User Content (as defined below), including without limitation, the text, software, graphics, photos, music, videos, and the like (“Content”), is owned by or licensed to Kenzie’s Optics and is subject to trademark, copyright and other intellectual property laws of the United States and foreign countries. Content on the Websites is provided for your personal use only and may not be used, copied, reproduced, distributed, transmitted, broadcast, displayed, sold, licensed, or otherwise exploited for any other purposes whatsoever without the prior written consent of Kenzie’s Optics. Kenzie’s Optics reserves all rights not expressly granted in and to the Websites and the Content.
- Privacy Policy. Our Privacy Policy governs the collection, use and disclosure of all Personal Data (personally identifiable information about you, such as your full name, birth date, e-mail address or mailing address, phone number and any other information that can be used to identify or contact you). - User Content. You may be able to post or provide user-generated content to Kenzie’s Optics through the Websites, such as reviews, comments, photos, articles, music, and videos (“User Content”). You will remain the owner of the User Content. By providing User Content to us, you grant Kenzie’s Optics an irrevocable, perpetual, non-exclusive, transferable, fully paid, worldwide license (with the right to sublicense) to use, copy, publicly perform, publicly display, modify, translate, excerpt (in whole or in part) and distribute such User Content for any purpose, commercial, advertising, or otherwise, on or in connection with Kenzie’s Optics. By providing User Content, you represent that you have the right to provide the User Content, that no third party rights will be violated by such posting, and that you have the right to grant Kenzie’s Optics the rights described in this paragraph.
- Websites Provided “As Is.” You understand and agree that the Kenzie’s Optics Websites and all services and information provided on it are provided “As Is” and that Kenzie’s Optics assumes no responsibility for the accuracy, timeliness, deletion or mis-delivery of any user communication, information, or configuration. You, and not Kenzie’s Optics, are entirely responsible for all material that you post, transmit or otherwise make available through the Websites. Kenzie’s Optics does not review or control the material that others post, transmit or otherwise make available through the Websites, and accordingly Kenzie’s Optics does not guarantee the accuracy, integrity or quality of such material. You acknowledge that Kenzie’s Optics and its designees shall have the right (but not the obligation) in their sole discretion to refuse or remove any material that is available through the Websites, including all User Content. Kenzie’s Optics will use reasonable efforts to control the security of the Websites, but does not warrant that it will be able to protect any content provided on or through the Websites from infringement or piracy. You understand and agree that Kenzie’s Optics will have no liability for any negligence or lack of due care in failing to protect the security of the Websites.
- Indemnification. You agree to indemnify and hold harmless Kenzie’s Optics, and its successors, affiliates, officers, agents, and employees, from any claim or demand by any third party arising out of material you post, transmit or otherwise make available through the Websites, your use of the Websites, your connection to the Websites, your violation of these Terms of Use, or your violation of any rights of another person or entity.
- Limitation of Liability. Kenzie’s Optics and its successors, affiliates, officers, agents, and employees are not responsible or liable for any damages or harm arising out of or relating in any way to the Websites, including the content or any information received from the Websites or through the Websites. Your sole remedy for dissatisfaction with the Websites is to stop using them and the information obtained from, and services provided in connection with the Websites.
- Governing Law and Jurisdiction. These Terms of Use and the relationship between you and Kenzie’s Optics shall be governed by the laws of the State of Georgia. You hereby consent to the exclusive jurisdiction of the federal and state courts located in the State of Georgia for all purposes in connection with any action or proceeding which arises out of or relates to your use of the Websites, these Terms of Use, or any Content, Personal Data, or User Content.
- Cancellations/Refunds/Backorders. Kenzie’s Optics reserves the right to cancel and refund orders for any reason, including pricing errors. Kenzie’s Optics offers a 30 day return window for customers. In those 30 days, if you are not happy with your purchase you can return your item for a refund, store credit, or exchange. - Modifications. We may modify these terms of use from time to time. If we make material changes to these terms, we will notify you by posting a revised version of these terms on the Websites. Your continued use of the Websites after notice of a modification indicates your acceptance of the revised terms.
Mobile Terms of Service
Kenzie’s Optics

The Kenzie’s Optics mobile message service (the “Service”) is operated by Kenzie’s Optics (“Kenzie’s Optics”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.
By consenting to Kenzie’s Optics’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Kenzie’s Optics through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).
You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Kenzie’s Optics. Your participation in this program is completely voluntary.
We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.
You may opt-out of the Service at any time. Text the single keyword command STOP to 41291 or click the unsubscribe link (where available) in any text message to cancel. You’ll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Kenzie’s Optics mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.
The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.
To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.
